These Terms of Service ("Terms") govern your use of the Myyol mobile application (the "App") offered by Rothzerg Pty Ltd, trading as Myyol ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy.

Summary. Myyol is a wellness companion for quitting or reducing smoking and vaping; it is not medical advice. Paid subscriptions renew automatically unless you cancel in your Apple App Store or Google Play Store account settings at least 24 hours before the end of the current period (where those platforms apply). The free version may display ads.

1. Eligibility and acceptance

You must be old enough to enter a binding contract in your jurisdiction and meet any minimum age required by the App Store or Google Play. If you do not agree to these Terms, do not use the App.

2. The service

Myyol provides tools and information to support a smoke-free or reduced-use journey, which may include:

  • Quit date tracking, streaks, progress summaries, and relapse ("slip") logging if you choose
  • Estimates of money saved, time reclaimed, and cigarettes avoided, based on inputs you provide
  • Health-related milestones and educational timelines for motivation
  • Craving or coping flows and distraction mini-activities
  • Optional local reminders and notifications when enabled
  • Premium features, which may include expanded content, additional activities, and cloud-oriented benefits such as periodic sync of your quit profile for backup and continuity

Features may change over time. We may add, modify, or remove functionality, subject to applicable law and any commitments we make to paying subscribers where required.

3. Not medical advice

The App is a general wellness and habit-support tool. It is not a medical device and does not diagnose, treat, cure, or prevent any disease. It does not replace advice from a qualified health professional. Nicotine dependence, withdrawal, medications, and mental health concerns should be discussed with a clinician. You use the App at your own risk as to health decisions.

4. Accounts and security

Where the App requires or offers an account, you agree to provide accurate information and keep your credentials confidential. Notify us promptly at [email protected] if you suspect unauthorized access. You are responsible for activity under your account except where our systems are clearly at fault.

5. User content and data

You retain ownership of information you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, back up, display, and use that information solely to operate, secure, and improve the App (including aggregated or de-identified analytics). You represent that you have the right to provide the data you enter.

6. Subscriptions, billing, and ads

Premium is offered where available through in-app purchase. Pricing, taxes, and billing cycles are shown at purchase and managed by Apple or Google. We use third-party services (such as RevenueCat) to verify entitlements. Subscriptions renew automatically until cancelled in your store account settings. Cancellation stops renewal at the end of the current period; refunds follow the store's policies—we do not control those decisions.

The free tier may show third-party advertisements (for example through Google AdMob). Ad content is provided by ad networks; we do not endorse advertised products. Premium may reduce or remove ads as described in the App at the time of purchase.

7. Acceptable use

You agree not to:

  • Use the App unlawfully or to harm others
  • Attempt to gain unauthorized access to our systems, other users' data, or underlying software
  • Reverse engineer, scrape, or overload the App except where applicable law forbids such a restriction
  • Circumvent payment, geoblocks, or security measures
  • Use the App to distribute malware or infringing material

We may suspend or terminate access for violations or risk to the service or users.

8. Intellectual property

The App, Myyol branding, and related materials are owned by us or our licensors. These Terms do not grant you any rights except a limited, revocable, non-transferable licence to use the App for personal, non-commercial purposes in line with the store rules you obtained it from.

9. Third-party services

The App relies on services such as Google Firebase (authentication, database, analytics, crash reporting, messaging, ads) and subscription platforms. Their terms and privacy policies also apply to their processing. We are not responsible for third-party services outside our reasonable control.

10. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that the App will meet your goals for quitting or reducing use.

11. Limitation of liability

To the fullest extent permitted by applicable law, we and our affiliates, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App. Our aggregate liability for claims relating to the App is limited to the greater of (a) the amount you paid us for Premium in the twelve months before the claim or (b) one hundred Australian dollars (AUD 100), if you only used free features or no payment applies—except where liability cannot be limited by law (for example certain consumer rights in Australia or elsewhere).

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of others' rights, to the extent permitted by law.

13. Termination

You may stop using the App at any time and delete it from your device. We may suspend or terminate access if you breach these Terms, if we must comply with law, or if we discontinue the service with reasonable notice where practicable. Provisions that by nature should survive (disclaimers, liability limits, disputes) will survive termination.

14. Changes

We may update these Terms. We will post the revised Terms in the App or on this site and update the "Last updated" date. If a change is material, we will provide additional notice where required by law. Continued use after the effective date constitutes acceptance of the updated Terms where permitted.

15. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. You agree that the courts of Australia have exclusive jurisdiction for disputes, subject to any non-waivable rights you may have as a consumer to bring claims in your country of residence.
